These terms govern use of the Gamorium presence bot in any Discord server it has been added to. Use of the bot is also subject to Discord's own Terms of Service and to our site terms and imprint. Where these bot terms and the site terms both apply to the same question, these apply to the bot.
Nothing in these terms asks you to agree to how we handle data. That is set out separately in the bot privacy notice, which we provide separately as the GDPR privacy information for the bot. It is not a contract term, and accepting these terms is not consent to anything in it. Where the notice relies on your consent, that consent is asked for separately and explicitly, in the bot, and can be withdrawn there.
The Gamorium presence bot is provided free of charge. We do not promise uninterrupted availability, or that its classifications and activity measurements will always be accurate. We may change, suspend or discontinue the bot or individual features at any time, subject to any mandatory statutory rights.
The scores it reports are Gamorium's argument about what a game tests, not a measurement. They are written by a language model (Anthropic's Claude) applying a framework we defined, and most of the catalogue is scored in bulk without a human reading it first. We hold editorial responsibility for them. Treat them as a case to argue with, not a verdict to accept, and not as purchasing advice.
The bot is intended for adults aged 18 or older, matching the site. We do not knowingly offer it to minors. We may stop serving a user or a server that breaches these terms, without notice where the breach is ongoing or automated.
Adding the bot is a decision that touches every member of that server, because Discord delivers presence for all of them. We strongly encourage you to tell your members the bot is there and to point them at its privacy notice. Adding it grants you no visibility into what any member plays, by design, and members keep full control of their own data through Discord's activity settings and the bot's /consent command.
We are liable without limit for intent, gross negligence, and injury to life, body or health. For ordinary negligence we are liable only if we breach a cardinal obligation - a duty so central that meeting it is what makes proper performance possible at all, and on whose observance you may reasonably rely. Even then we owe only the damage that was foreseeable and typical for a contract of this kind. Beyond that, our liability for ordinary negligence is excluded. Liability under the German Product Liability Act remains unaffected.
German law applies, without prejudice to the mandatory consumer-protection law of the country in which you have your habitual residence. If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for disputes arising from these terms is Aichach. Should individual provisions be invalid, the validity of the remaining provisions is unaffected. Your mandatory statutory consumer rights - including your statutory place of jurisdiction - remain unaffected by these terms. The version published here, with its revision date, applies.
